Long battle over the Gran Havana Lounge in San Diego ends: “I know people may think I may walk away a winner. But believe me, there is no winner.” That’s Ahmad Mesdaq, who invested nearly $2 million to make his Gran Havana Cigar & Coffee Lounge a success at the corner of 5th and J Streets in San Diego’s Gaslamp District, only to have his shop closed in 2004 by the city’s development agency under its powers of eminent domain. His 5,000 sq. ft. property was condemned to make way for a hotel being built by a private developer, which is finally supposed to break ground in July. Over the course of the last three years, he sued and won, then saw elements of the verdict overturned at the appellate level. At last, however, the end is in sight. The original jury trial ended with an award to Mesdaq of $7.8 million in damages and $1.2 million for legal fees. After lengthy negotiations, the Centre City Development Corporation finally agreed to pay Mesdaq $7.8 million in total and he will have to pay his legal fees of between $1-2 million. Mesdaq told the San Diego Union-Tribune that he’d like to open a new shop in the vibrant Gaslamp District, but he’s going to take it slow for now. “Any business shut down for three years is hard to restart,” he told reporter Jeanette Steele. “I’m taking one step at a time.
